From January to December 2012, there occurred seven significant maritime cases in Guangdong waters. Yang & Lin Co. Law Firm has served as the agent ad litem in all these seven cases. The details of the above-mentioned seven cases are as follows:
1. On 22 February 2012, there occurred a collision between the vessel “Zhen He” and the vessel “MOL Maneuver” in the sea waters of Dangan Island to the south of Hong Kong, which caused the total loss in sum of about USD 20.90 million. Yang & Lin handled the case on behalf of COSCO Container Lines Co., Ltd (the ship-owner of “Zhen He”), Shanghai Panasia Shipping Co., Ltd (the carrier), PICC Shanghai Branch (the hull insurer of “Zhen He”) and West of England P & I Club.
2. On 2 March 2012, the vessel “Dream Diva” collided with “Bo Yun 018” in Ling Ding Waterway of the Pearl River, which led to the sinking of the vessel “Bo Yun 018”, the missing or death of 8 crew members and the leakage of about 70 tons of bunker from the vessel “Dream Diva”. Guangzhou MSA organized and conducted the salvage and oil cleaning. The fee of the salvage and oil cleaning was about USD 2.89 million. Yang & Lin handled this case on behalf of Guangzhou MSA.
3. On 13 March 2012, the South Korean cargo vessel “Kenos Athena”, loaded with about 7000 tons of sulphuric acid, sank in Guangdong Shanwei waters. This accident is the most significant sulphuric acid shipwreck accident in waters of our country throughout history. Yang & Lin fully handled this case on behalf of the ship-owner of “Kenos Athena” and her P & I Club (Korea Shipping Association). The total loss for this accident was about USD 8,000,000.
At about 1830 hrs on 20 March 2012 and at about 1915 hrs on 23 March 2012, the journalists of CCTV (China Central Television) News Center interviewed Mr. Colin Y F Yang, the managing partner of Yang & Lin, twice about the case of the sinking of the South Korean vessel “Kenos Athena” in Shanwei of Guangdong which was handled by Yang & Lin. CCTV-13 Channel (news channel) respectively reported the above-mentioned two interviews on the Live News at 1418 hrs on 21 March 2012, on the News 30 Minutes at noon of 24 March 2012 and on the Live News at 1728 hrs on 24 March 2012. In addition, Guangdong Satellite TV also reported the second interview of Mr. Colin Y F Yang by the journalists of CCTV News Center on Guangdong News Broadcast on 24 March 2012.
4. On 7 April 2012, the vessel “Zhong Hai Gao Su” collided with the vessel “Paphos” at the waters of Dangan Island to the south of Hong Kong, which caused the total loss in sum of about USD 1.60 million. Yang & Lin handled the case on behalf of China Shipping Car Carrier Inc. (the ship-owner of “Zhong Hai Gao Su”), PICC Dalian Branch (the hull insurer of “Zhong Hai Gao Su”) and West of England P & I Club.
5. On 23 July 2012, “San Hang Sha Zhuang 8” collided with M/V “Xin Ri Zhao” at Ling Ding Waterway of Pearl River, causing the sinking of “San Hang Sha Zhuang 8”. The losses arising from this accident was about USD 17.68 million in total. Yang & Lin handled the case on behalf of Operation Center of Shipping Insurance Department of CPIC Property & Casualty Insurance Company Ltd, the hull underwriter of “San Hang Sha Zhuang 8”.
6. On 14 September 2012, the vessel “Asian Grace” underwritten by Britannia P & I Club collided with Weiyuan Jetty located in Humen, Dongguan, Guangdong and owned by Unit 92016 of South China Sea Fleet of Navy of the Chinese People's Liberation Army, which led to the severe damage of the jetty. Unit 92016 of South China Sea Fleet of Navy of the Chinese People's Liberation Army claimed against the ship side for about USD 3.75 million. Yang & Lin handled this case on behalf of the ship-owner of “Asian Grace” and her P & I club. The case was settled by the mediation of Dongguan MSA and the compensation amount was about USD 1,74 million, which earned the client’s satisfaction. Unit 92016 of South China Sea Fleet of Navy of the Chinese People's Liberation Army respectively presented Dongguan MSA, Britannia P & I Club and Yang & Lin a model of the first aircraft carrier “LIAO NING” in China.
7. On 2 December 2012, “Xin Hong Xiang 18” collided with a Hong Kong fishing vessel “CM90094V” (Yang Po 0281) at the waters of Shanwei, Guangdong, which led to the sinking of “Xin Hong Xiang 18” and the missing of 9 crew members on board. Yang & Lin handled this case on behalf of the ship-owner of “Xin Hong Xiang 18”, Hong Xiang Shipping Company and her insurer PICC Property and Casualty Company Limited, Guangxi Zhuang Autonomous Region Branch.
In addition, Yang & Lin handled another collision case occurring in Guangdong waters in July of 2012.
On 19 July 2012, the vessel “Peng Nian” collided with the vessel “Chang Zhong” at the waters of Ling Ding Fairway, which caused the loss in sum of about USD 803,858.52 in total. Yang & Lin handled the case for and on behalf of Shenzhen Ocean Shipping Co., Ltd (the ship-owner of “Peng Nian” ) and PICC P&C Guangdong Branch.
Furthermore, Yang & Lin also handled one significant collision case occurring in Shandong waters in August of 2012.
On 23 August 2012, there occurred a collision between the vessel “CSB Propitiousness” and the vessel “Ocean Planet” in the sea water off Rizhao port of Shandong Province, which caused the loss in sum of about USD 8.04 million in total. Yang & Lin handled the case on behalf of Jixiang Shipping S.A. (the ship-owner of “CSB Propitiousness”) and Swedish P & I Club. Wang Jing & Co, Qingdao handled this case on behalf of the ship-owner of “Ocean Planet”.
