2019 年 2 月 16 日， “艾丽肯(Elikon) ”轮于巴西圣塔伦港装运 45, 941.434 公吨大豆并出具了清洁提单；2019 年 4 月 12 日至当月 18 日 “艾丽肯"轮抵达广西防城港卸载作业时发现前述提单项下大豆热损，货物出现发霉、变色、水湿和结块等现象。要求船方提供了由UK保赔协会签发的金额为232, 000, 000 元的担保函。
大 豆 的 货 主 广 西 惠禹 粮 油 工 业 有 限 公 司 和 货 物 运 输 保 险 人 中 国平安财产保险股份有限公司均对涉事船舶提起诉讼，认为货损应归责于承运人，要求涉事船舶的船东艾丽肯航运公司赔付货物损失 744, 009 美元及保险金损失人民币 2, 600, 000 元，合计约人民币 7, 481, 513 元。我所代表船东艾丽肯航运公司参加了诉讼。在法院主持的调解下，本案最终以 405万与原告调解。我所林翠珠、杨运福、丁亭代表被告中国人民艾丽肯航运公司处理本案。经过我所的最大努力，为委托人大大减少损失，取得了令委托人非常满意的结果。
该案典型意义：我国法院法官公平公正平等对待境外当事人和审理涉外案件。
On 16 February, 2019, MV "Elikon" shipped 45, 941.434 metric tons of soybeans in Santarém port Brazilian, and issued clean bills of lading. From 12 April to 18 April, 2019, when MV "Elikon" arrived at Fangchenggang in Guangxi during unloading operations, it was found that the soybeans under the aforementioned bills of lading suffered heat damage, and the goods were moldy, discolored, wet and caked. The ship was required to provide a letter of guarantee issued by the UK P & I Club in the amount of RMB 232, 000, 000 yuan.
The cargo owner of the soybean, Guangxi Hui Yu Oils and Grains Industries Co., Ltd., and the cargo transportation insurer, Ping’An Property Insurance Co., Ltd. of China, both brought lawsuits against the ships, arguing that the cargo damage should be attributed to the carrier, the ship's owner, Mount Elikon Navigation S.A, was required to pay compensation of US $744,009 for the loss of the goods and 2,600,000 yuan for insurance compensation (RMB 7,481,513 in total). We took part in the lawsuit on behalf of the owner of the ship, Mount Elikon Navigation S.A. Under the mediation presided by the court, the case was finally settled with the plaintiff in the amount of 4.05 million.
